Welcome to Daily Simchas. These Terms of Service (the “Terms”) are an agreement between you and Daily Simchas (“we,” “us,” or “our”) and govern your use of dailysimchas.com and any related apps and services (together, the “Service”). By using the Service — browsing the board, creating an account, posting a listing, or purchasing a paid feature — you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service is

Daily Simchas is a community board where members of the community post upcoming simchas — such as a vort, chasunah, sheva brachos, shalom zachor, bris, bar mitzvah, or kiddush — so friends, family and neighbors know when and where to share in the joy. Listings are written and published by the people who post them, not by us. We provide the board; the community provides the simchas.

2. Accounts and eligibility

You must be at least 18 years old to create an account or post a listing. You agree to provide accurate information when signing up and to keep your sign-in method (your email inbox or Google account) secure. You are responsible for activity that happens under your account. We may suspend or close accounts that violate these Terms.

3. Posting a simcha — your promise to us

Every listing describes real people and often a real address. When you post a listing, you represent and warrant that:

  • the simcha is your own family’s, or the family has personally authorized you to post it;
  • the information you post is accurate to the best of your knowledge;
  • if the event is at a private home, the household has agreed to have the address published;
  • any flyer or image you upload is one you have the right to share (for example, the family’s own invitation given to you for this purpose).

Posting details of someone else’s simcha without their permission is a serious misuse of the Service. Such listings are removed, and repeat misuse leads to a posting block or account closure.

4. Acceptable use

You agree not to:

  • post false, misleading, or unauthorized listings;
  • use the Service to harass, embarrass, or harm anyone;
  • post advertising or content unrelated to a genuine simcha;
  • scrape, harvest, or bulk-collect listings or personal information from the board;
  • interfere with the Service’s security or operation, or circumvent its safeguards.

5. Your content and our license

You keep ownership of what you post. So that the Service can work, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your listing and any uploaded flyer — on the board, in email digests and notifications sent to subscribers, and in link previews when a listing is shared. This license ends for a listing when it is removed, except as needed for backups, legal compliance, and records of moderation.

6. Paid features and refunds

Some features are paid — for example, uploading a flyer, featuring a listing, or, in the future, posting itself. Prices are shown in U.S. dollars at the time of purchase and may change. Payments are one-time charges (no subscriptions) processed by Stripe, our payment processor; we never see or store your card number.

Refunds. Because paid features take effect immediately, purchases are generally final. We will refund a purchase where the paid feature was not delivered because of a fault on our side, and we may refund at our discretion in other cases — for example, where a paid listing was removed through no fault of yours. To request a refund, contact us via the feedback form with your listing code.

7. Reports, removals, and moderation

Anyone can report a listing. A report that the family did not authorize a posting takes the listing off the board immediately, pending review. We may remove any listing, block posting from an account, or refuse any content, at our discretion, to keep the board accurate and respectful. If your listing is removed you will be notified by email with the reason and a way to respond. Families who want a listing about them taken down can use the “Report this listing” option on the listing page — see our Privacy Policy for how removal requests are handled.

8. Copyright complaints

We respect copyright. If you believe content on the Service infringes your copyright — for example, an uploaded flyer you designed — send us a notice via the feedback form including: (a) the work you claim is infringed, (b) the listing code or URL of the material, (c) your contact information, (d) a statement that you have a good-faith belief the use is not authorized, and (e) a statement, under penalty of perjury, that your notice is accurate and you are the copyright owner or authorized to act for them. We will remove infringing material promptly and may terminate repeat infringers’ accounts.

9. What we do not promise (disclaimers)

Listings are posted by users, and we do not verify them. Dates, times, and addresses can be wrong, and events can change or be cancelled without the listing being updated — please confirm details with the family before relying on them. The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, uninterrupted availability, or fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, Daily Simchas and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

If you post a listing without the authorization these Terms require, or otherwise violate these Terms, and that leads to a claim against us, you agree to indemnify and hold us harmless from the resulting losses, costs, and reasonable attorneys’ fees.

12. Changes to the Service and to these Terms

We may change or discontinue features, and we may update these Terms. If a change is material we will post the updated Terms here with a new effective date and, where appropriate, notify account holders. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in New York, and you consent to their jurisdiction.
